High Court of Australia asylum seeker test case

Plaintiff M70/2011 v Minister for Immigration and Citizenship & Anor; Plaintiff M106 of 2011 by his Litigation Guardian, Plaintiff M70/2011 -v- Minister for Immigration and Citizenship & Anor [2011] HCATrans 223 


The High Court of Australia will on Wednesday 31st August 2011, deliver its judgment on an injunction application brought before the Court by two asylum seekers, one of which is a juvenile that seeks the Court's direction to the Commonwealth Government to process their application for refugee status on Australian sovereign soil.

Put simply it is a test case that will have wide legal and international ramifications. Effectively the judgment will either endorse the agreement that Australia has with Malaysia or it will reject it, thereby making unlawful Australian proposed deportation of asylum seekers to countries beyond Australian shores.
